How do you think popular sovereignty has impacted and will impact Davis' court case?

  1. I think popular sovereignty could leadt to Davis' release. What I would like to know is can popular sovereignty over rule evidence? I remember in Nate's presentation that Davis' whereabouts were a little fuzzy during the second and third people. If his supporters believe that he innocent, and he is released, could new found evidence put him right back in the same position he is in now? These were some questions I had thought of after class.

  2. I also think that the with the help of popular sovereignty Davis may be released. I think because there are a majority of witnesses that have recanted their statements, and there is a lack of evidence, the defense may try to sway the jury to have a retrial or something of the sorts to try to lessen Mr. Davis' sentence and try to get him off of death row.

    I think popular sovereignty may be able to lead to the release of Troy Davis. The jury can't ignore the number of people that believe Davis is innocent. It should at least cause them to delay the execution and review over the material they have. His execution has already been delayed before due to the lack of evidence. So the jurors will have to consider everything they have. The people should have a voice in this case.

  4. I don't think that popular sovereignty will reeally save Davis, especially if evidence leads him to committing the crime. But like Laura said, it could possibly save him because of the lack of clear evidence. Since, so many people are banding together to deny the death penalty on Davis, it could save him just like any other protest has changed something a large majority didn't like or approve of. We will have to find out tomorrow..

  5. I agree with Jurnee for the majority, If the evidence is there then the evidence is there. I think the only reason why popular sovereignty could save Davis is because Davis story was a little lost. As much as i'd like to say the people should have a voice in the case, i don't think popular sovereignty is strong enough to save Davis on this.

  6. I also agree with everyone els with popular sovereignty playing a role in this case to some extent. Even though Davis does look bad, with all the people protesting to save him from the death penalty it makes you think twice about if he really is innocent. But it also might not be enough, even though the story is fuzzy the evidence they do have sounds very convincing and protesting might not be enough at this point.

  7. I agree with Allie also. I don't think that popular sovereignty will play a role in this case. The judge and jury don't care what people have to say about it, it only matters what they think. This case reminds me of what happened to Casey Anthony. Almost everyone in the US thought she was guilty but no matter what people thought, the jury still found her innocent. Because it is a jury of peers, they may have the same views as the people protesting, but the protests shouldn't influence their final decision on a man's life.

Although popular sovereignty is being displayed by people showing their support; protesting the thought of Davis being condemned to the death penalty, I do not think the protesting will save the outcome of Troy Davis. I believe along with Kayla, Allie, and Jurnee that the judge and the jury will have the final say and even though they may take in to consideration the thoughts of the people protesting, they will still find Davis guilty.

  9. In my opinion, I do not believe that popular sovereignty will lead to Davis' release. Even though the whole point of popular sovereignty and voting is to make sure the people of America have a say, I do not think that the jury will take this protest into consideration, because the people who aren't on the jury should have no say in what happens to criminals. Just because they believe he is innocent because there isn't enough solid evidence to prove he's guilty, isn't enough to change the Jury's decision. Like Allie, Kayla, Jurnee, and Andrea, I believe that the judge and the Jury will be the deciding factor on whether or not Davis is executed tomorrow, and that their decision will not be impacted by popular sovereignty.

  10. I agree with Kayla on this. I think that people's thoughts or opinion on the Davis case can really persuade people's decisions. I do not think that the jury should even think about how people have been protesting, or care about anyone else's opinion during the case. A fair trial does not have to mean he is found innocent, if the jury is pressured by protestors and lets him go, he still did not get a fair trial. I think that he will be put to death, and that the opinions of other's will not sway the jury.

  11. I also agree with Kayla. If you are having a meeting with a board of something or other and they are going to kick you out but they don't havee evidenc to support most of their accusations, and their families come in and support me then I deffinatly think that they will be more inclined to change their minds. But even if it does not change their minds, it will change his life, seeing that so many people see his innocence and are willing to fight for him and I think that would have a great presence of gratitiude over his life as it would anyone. Furthermore, if he does have to die I think if he is innocent, that it will make the departure from this world that much easier. So, yes i think that it will have an impact if not in the proof of innocence then in the hearts not only him but of others in that case.

  12. I also agree with Sydney, the decision on wether or not Davis is released or facing the death penalty is up to the judge and jury's ruling. The case is not directly influenced by popular sovereighty, if there is credible and enough evidence to prove Davis being guilty,or if there is not, it will still be up to the court to what charges and prosecutions Davis will be faced with. A number of protesters do not have the power by law to decide who is and who is not guilty in court, however I do believe that the court will take another study of the evidence due to the awareness andhype of the protesters cause. Popular sovereighty will not decide on Davis's final fate in the court ruling.
